How can divorce mediation work if my ex and I always disagree?

April 14, 2017

Divorce mediation is an alternative for divorcing Connecticut couples who want to avoid litigation. Although this is an attractive option for many, there are concerns about how effective this form of dispute resolution can really be for combative couples. While some couples are more than willing to negotiate the terms of their divorce in order to save time and money, some are very emotional and refuse to give in out of spite. Divorce mediation can help some of these couples come to a peaceful resolution.

Emotions tend to run high during a divorce, especially when one party does not want to divorce or when the divorce was caused by a spouse’s infidelity. The jilted party may wish to seek revenge by arguing over every detail in the divorce. While the spouse may find this to be the best way to get at the offender spouse, this tactic often delays the process and end up costing more money in the long run.

Good mediators are familiar with working with these types of couples. They know how to get emotional couples to calm down and encourage them to see eye to eye on various issues such as property division and alimony. Mediators also know how to present the benefits of mediation so that couples can see how it can be effective.

Divorce mediation can work for many couples, but they must be willing to put their feelings aside and focus on the goal: getting through the divorce as quickly and painlessly as possible. It’s not in anyone’s best interests to drag on the divorce any longer than necessary. With some convincing from a skilled mediator, even a volatile couple can agree on important issues.

Broder Orland Murray & DeMattie LLC has mediated numerous cases, which have resulted in positive outcomes. Our lawyers have also acted as “coaches” to parties engaging elsewhere in mediation and as review counsel once an agreement is generated. We can help you determine if mediation is the correct approach for your case.
