Are There Any Differences Between a Same-Sex Divorce and an Opposite-Sex Divorce in the State of Connecticut?

Just 7 or 8 years ago, this would have been the subject of a 2-hour continuing legal education class, but that’s no longer the case. There are provisions for alimony, child support, parenting plans, and asset division, and all are bound by the same parameters and guidelines, whether a same-sex divorce or opposite-sex divorce.

What Issues Differ in a Same-Sex Divorce Compared to an Opposite-Sex Divorce?

The only issues that tend to arise are in regard to parenting. When one partner in a same-sex marriage adopts a child, and the other partner has not adopted that child, it can certainly impact parental rights. Issues may also arise with surrogate parents. Child custody is often a significant issue in a same-sex divorce, particularly whether there is a right to have custody. Before filing for divorce, it is crucial to understand your legal relationship with that child.

Has There Been an Increase in the Number of Same-Sex Divorce Filings?

Same-sex marriage has been legal for some time, and we are now seeing that some of those relationships are starting to break down. As a result, far more same-sex spouses are filing for divorce. As I have said, same-sex divorces are treated no differently than opposite-sex divorces.
