What is the Difference between a Legal Separation and a Divorce in Connecticut?

A decree of Legal Separation essentially has the same impact and effect as a divorce except that when legally separated neither party is permitted to remarry. The Legal Separation is a document which will be a court approved agreement. It can define the custody of the children, a parenting plan, a property settlement, and the amounts of alimony and child support to be paid. Once legally separated, if either party wants to convert the separation into a divorce, they are permitted to do so. It is not necessary for there to be mutual consent. It should be noted that legal separations are rarely done in the State of Connecticut.
