Divorce mediation increasingly used to settle disputes

When Connecticut couples divorce, it can be a stressful time, but, fortunately, there are options. They no longer have to spend tens of thousands of dollars battling their soon-to-be ex-spouse in court. Instead, they can choose divorce mediation and save money and time, while negotiating on the issues that are important to them. This is an especially favorable option, if the couple is ending the marriage on good terms.

With 95% of court cases ending in a settlement, it makes sense to seek out mediation and resolve common divorce issues, such as child support, child custody and spousal support, in half the time and money spent. The spouses decide on these issues together, which gives them, instead of a judge, control.

Mediation involves a mediator who acts a neutral party. He or she can answer questions about laws, help come up with creative proposals and guide the parties in the right direction, but the mediator must refrain from giving advice. The goal is to have the parties agree on these issues on their own, without interference. Although lawyers are typically not permitted to attend mediation sessions, the parties can consult with their attorneys afterward and tweak agreements, as needed.

Although mediation can work very well for many couples, it is not effective for everyone. Some divorces are highly complex and involve various types of assets. Trying to negotiate all these in a mediation setting can become cumbersome. Plus, many couples have bitter splits and are no longer on speaking terms. Therefore, most divorcing couples continue to choose to settle their disputes in court.
